If you are interested in concluding a rental contract, you must first complete a written application in which you must also provide personal data. This data is used to identify the contractual partner or the persons acting on their behalf and enables us to check the contractual partner. The legal basis for this is the performance of the contract within the meaning of Art. 6 (1) point b GDPR, which also includes the contract initiation from the time of application or expression of interest.
In the course of the contract review, it is also necessary to identify the person who signs the rental contract either for themselves or for a company they represent. This check is necessary because the contract can be concluded online without personal contact as standard and we bear a risk of advance performance in the course of the fulfilment of the contract. We therefore want to be sure of the identity of our contractual partners or their representatives, including an official photograph. We offer various alternatives for identification, including the submission of a copy of an official photo ID or the use of a verification service that we accept. If you intend to use a copy of an ID card for identification, we also accept redaction of the non-relevant areas or information, but not of the image, in line with the recommendations of the supervisory authority. Alternatively, we also offer the option of electronic identification via service providers accepted by us, such as IDNow.
The contract documents, including the original application and the associated personal data, remain stored for the duration of the contractual relationship and after its end until all conceivable contractual claims have become time-barred (usually three years). After that, the data will be deleted, unless we are subject to longer retention obligations (about ten years for documents relevant under commercial and tax law).
